Progyny, Inc. and its affiliates and subsidiaries (collectively “Progyny”, “us”, “we”, or “our”) operates the https://progyny.com website, member portal, provider portal and member mobile application (together with and other applications or services that link to this privacy policy, the “Service”).

This privacy policy informs you of our policies regarding the collection, use and disclosure of Personal Data, hereinafter defined, when you use our Service and the choices you have associated with your information (our “Privacy Policy”).

We use your data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy and our Cookie Policy. Unless otherwise defined in this Privacy Policy, the terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, accessible from https://progyny.com.

Please note, our privacy practices are subject to the applicable laws of the places where we operate.  Some of the terms of our Privacy Policy may only apply to customers located in particular geographic regions.

Sources of Data

We collect information about you from the following categories of sources:

You (Actively)

You may actively provide us information when you use our Service such as through our website, member portal, provider portal, mobile applications, emails, social media, surveys, customer support, or any other online or offline interactions.

You (Passively)

You may also passively provide us information through your interactions and use of our Service such as your IP address, access times, hardware and software information, device information, device event information (e.g., crashes, unsuccessful logins, browser type), the web pages you’ve viewed or engaged with before and/or after using the Service, and other relevant usage information. We may use cookies and other tracking technology to collect this information. Third Parties

We may receive information about you from third parties such as business partners and service providers to operate our business and improve your experience and interactions with us.

Publicly Available Databases

We may receive information that is available publicly, either online or offline, to operate our business and improve your experience and interactions with us.

What Types of Data Do We Collect

Personal Data

While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“Personal Data”). Personally identifiable information may include, but is not limited to:

  • Email address
  • First name and last name
  • Phone number
  • Address, state, province, ZIP/postal code, city
  • Demographic information, including age gender, race, ethnicity, and household information, some of which may include characteristics of protected classifications under U.S. state or federal law
  • Employer information
  • Benefit plan information, such as carrier member ID, date of eligibility, and payor ID
  • Health information, such as information regarding medical conditions or medical treatments
  • Inferences drawn from or created based on any of the information identified above
  • Biometric information
  • Sensitive personal information

Some of the individually identifiable information we collect or that you provide us through the Service may constitute protected health information (“PHI”) under HIPAA. Information may be collected from users who register and log-in to the password-protected and secure portions of our Service, including our member portal, member mobile application, and provider portal (“Secure Platforms”).  To the extent information collected and stored by Progyny or added by/or about our users into such Secure Platforms is considered PHI, such information is governed by HIPAA and is not covered by this Privacy Policy.

Employees, job applicants and business contacts who are residents of certain states receive a supplemental privacy notice that applies to their relationship with Progyny.  In the event of any conflict or inconsistency with this Privacy Policy, the terms of the supplementary privacy notice will control to the extent of such conflict or inconsistency.

Usage Data

We may also track user IDs and collect information on how the Service is accessed and used (“Usage Data”). This Usage Data may include information such as your computer’s Internet Protocol (IP) address, browser type, browser version, the pages of our Service that you visit, the time and date of your visit, geolocation information, the time spent on those pages, unique device identifiers, other diagnostic device information, device event information (e.g., crashes, unsuccessful logins, browser type), and information from cookies or other technologies when you use our Service.

You may be able to adjust the settings of your browser or device so that information about your precise physical location is not sent to us or third parties by (a) disabling location services within the browser or device settings; or (b) denying certain websites or mobile applications permission to access location information by changing the relevant preferences and permissions in your mobile device or browser settings. Tracking Technology and Cookies Data

We use cookies and similar tracking technologies to track the activity on our Service and we hold certain information. Please see our Cookie Policy and the Analytics section below for information regarding how we use these technologies, the information they may collect from you, and how that information may be used and disclosed.

Transfer of Data

Your information, including Personal Data, may be transferred to – and maintained on – computers located outside of your state, or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.

If you are located outside United States and choose to provide information to us, please note that we transfer the information, including Personal Data, to the United States and process it there. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

Progyny, Inc. will take all the steps reasonably necessary to ensure that your information is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your information.

Tools Used to Manage What Personal Data We Collect

When using our Service, we may also provide in-time notices, requests to obtain your consent to use your Personal Data for certain practices, or opportunities to opt-out of use of your Personal Data for certain practices.  These in-time notices may only apply to individuals residing in certain states.

Protection and Management of Personal Data

Security of Data

We use numerous technical, administrative and organizational security measures, such as data encryption, authentication, secure messaging, administrative restrictions, and data loss prevention controls to maintain the security and integrity of your Personal Data.

The security of your data is important to us but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security. To ensure additional layers of security, you can keep your data safe by employing reasonable measures to protect your personal information against any unauthorized disclosure or unwanted use.

Data Retention

We retain your Personal Data for as long as necessary to fulfill the purposes described in this Privacy Policy, to provide our Service to you and to complete transactions for which your Personal Data was collected. We also retain all data as required and permitted by applicable law for compliance obligations, dispute resolution and subject to our record retention policies and procedures.

Consistent with applicable law, you may exercise the rights described in this section. Please note that some of the rights may vary depending on your country, province, or state of residence.

The Right to Opt Out of Cookies and Sale/Sharing Using Online Tracking Technologies

Our use of online tracking technologies may be considered a “sale” / “sharing” under applicable law. Visitors to our US website can opt out of being tracked by these third parties by taking the steps described in the Analytics section below.

You may also opt out by broadcasting an Opt-Out Preference Signal, such as the Global Privacy Control (GPC) (on the browsers and/or browser extensions that support such a signal). To download and use a browser supporting the GPC browser signal, click here: https://globalprivacycontrol.org/orgs.  If you choose to use the GPC signal, you will need to turn it on for each supported browser or browser extension you use.

Categories of personal information disclosed that may be considered “sale” / “sharing”: basic identifying information, device information and other unique identifiers, internet or other network activity, and geolocation data.

Categories of third parties to whom personal information was disclosed that may be considered “sale”/ “sharing” include advertisers and marketing partners, data analytics providers, and social media networks.

The Right to Limit the Use of Sensitive Personal Information

Progyny only collects sensitive personal information, as defined by applicable privacy laws, for the purposes described herein or with your consent.

Some of our purposes for the collection and processing of sensitive personal information may include: to perform the services or provide the goods reasonably expected; to prevent, detect, and investigate security incidents; to resist malicious, deceptive fraudulent, or illegal actions directed at Progyny and to prosecute those responsible for those actions; to ensure the physical safety of natural persons; for short-term, transient use; to perform services on behalf of Progyny; and to verify or maintain the quality or safety of a service provided by Progyny.

Progyny does not collect or process sensitive personal information for the purpose of inferring characteristics about you.  Therefore, Progyny does not offer the right to limit the use of sensitive personal information. 

The Right to Access, Correct, and Delete Personal Information

Depending on your state of residence in the U.S., you may have the right to request access to and receive details about the Personal Data we maintain about you and how we have processed it, correct inaccuracies, get a copy of, or delete your Personal Data. You may also have the right to withdraw your consent to our processing of your Personal Data.  These rights may be limited in some circumstances by applicable law.

You can submit a request to access, correct or delete your personal information, or withdraw consent, by submitting a Consumer Rights Request Form available at Consumer Rights Request Form | Progyny, by emailing privacyissues@progyny.com, or by calling us toll-free at 888.597.5065.

Responding to Requests

Once you have submitted your request, we will respond within the time frame permitted by the applicable law. Please note that we may charge a reasonable fee for multiple requests in the same 12-month period, as permitted by law.

Appealing Requests

Depending on your state of residence in the U.S., you may be able to appeal our decision to your request regarding your Personal Data. To do so, please contact us in any of the ways listed in the Contact Us section below. We respond to all appeal requests as soon as we reasonably can, and no later than legally required.

Identity Verification

For us to process some requests, we will need to verify your identity to confirm that the request came from you. We may contact you by phone or e-mail to verify your request. Depending on your request, we will ask for information such as your name, an e-mail address, mailing address, or phone number.

Authorized Agent

Depending on your state of residence in the U.S., you may designate an authorized agent to submit a request on your behalf to access or delete your personal information. To do so, you must: (1) provide that authorized agent written and signed permission to submit such request; and (2) verify your own identity directly with us. Please note, we may deny a request from an authorized agent that does not submit proof that they have been authorized by you to act on your behalf.

If you have been designated as an authorized agent to submit a request on behalf of another customer, you must make the appropriate selection when you submit a Consumer Rights Request Form.

Managing Communication Preferences

  • Email: You can stop receiving promotional e-mails at any time by clicking on the “unsubscribe” link at the bottom of any promotional e-mail that you receive from us.
  • Postal Mail: You can stop receiving promotional postal mail at any time by calling 888.597.5065.
  • Text Messages: You can opt-out of receiving text messages from us by replying “STOP” to the text message you receive from us. Please note that this will only opt you out of the specific text messaging program associated with that number.
  • In-App Push Notifications: You can stop receiving in-app push notifications in our Member App by adjusting your Notification Settings in the Member App.

We do not discriminate against any individual who opts to exercise their rights described in this Privacy Policy.

Disclosure of Data

Disclosure for Law Enforcement

Under certain circumstances, Progyny may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g., a court or a government agency).

Legal Requirements

Progyny. may disclose your Personal Data in the good faith belief that such action is necessary:

  • To comply with a legal obligation
  • To protect and defend the rights or property of Progyny
  • To prevent or investigate possible wrongdoing in connection with the Service
  • To prevent, detect, or investigate any forms of illegal use such as fraud or abuse
  • To protect the personal safety of users of the Service or the public
  • To protect against legal liability
  • To comply with applicable law, court orders or governmental requests

In connection with any reorganization, restructuring, merger, sale, acquisition, financing, dissolution, or other transfer of assets under the condition that the recipient agrees to respect your information in a manner that is consistent with this Privacy Policy, or to prospective purchasers to evaluate a proposed transaction.

Service Providers

We may employ third party companies and individuals to facilitate our Service (“Service Providers”), provide the Service on our behalf, perform Service-related services or assist us in analyzing how our Service is used.

These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated to employ industry standard technical or organizational measures to adequately secure and protect your Personal Data and not to disclose or use it for any other purpose.

Analytics

We may use third-party Service Providers to monitor and analyze the use of our Service. We use these Service Providers web analytics, cookies and other technologies to track usage of our website. These services provide multiple benefits to our Service by allowing us to improve our Services, obtain aggregate reporting and metrics, improve your experience, while enabling the Service Provider to conduct tasks on our behalf. We use multiple analytics tools of various Service Providers to provide and enhance our Services.

The tools we use from Service Providers are analytics tools which allow the tracking and reporting of website traffic to track and monitor the use of our Service. We also use these analytics services to receive information from Service Providers to review the productivity of advertisements.  To the extent we utilize any analytics or tracking tools on our Secure Platforms, such tools are HIPAA-compliant.

You have the ability to opt out of having your activity tracked by these Service Providers by managing your cookies via your browser and turning off all cookies. You do this through your browser settings on each browser and device you use. Each browser is different, so look at its Help menu for navigation on how to modify your cookies. You may also do so by visiting our Cookie Preferences Center available at https://progyny.com/cookie-policy and following the instructions there.

To opt out of Google Analytics you must install the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js and dc.js) from sharing information with Google Analytics about visits activity.

To opt-out of having your activity tracked and shared to us by LinkedIn you must go to your account settings and turn off the “interactions with business” toggle under the Ads tab.

To opt out of having your activity tracked and shared on the Service by Mixpanel, please ensure your “Do Not Track” settings are enabled in your dedicated web browser. If you are utilizing an iPhone or another device using Apple iOS and you would like to not have your activity tracked through the Member app, please go into your iPhone, or iOS device’s settings, followed by “Privacy & Security” then “Tracking” and ensure the green toggle switch for “Progyny” is off and grey. Our Service may contain links to other sites that are not operated by us. If you click a third party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit.

To the extent any linked websites or apps are not owned or controlled by us, we are not responsible for their content, any use of the websites or apps, or the privacy practices of the websites or apps. We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

Children’s Privacy

Our Service is not directed at children and does not address anyone under the age of 13 (“Children”).

We do not knowingly collect personal information from anyone under the age of 18. If you are a parent or guardian and you are aware that your Child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.

Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy.

We will let you know via a prominent notice on our Service, prior to the change becoming effective and update the “effective date” at the top of this Privacy Policy.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted.

  • Access. You can request that Progyny provide you a copy of the Personal Information that we have collected about you during the past 12 months.
  • Review/Correction. You can ask Progyny to correct inaccurate Personal Information.
  • Deletion. You can ask Progyny to delete the Personal Information that we have collected from you.
  • Right to opt out of sale and/or sharing. You have the right to opt-out of the sale and/or sharing of your Personal Information.  As discussed, we “share” certain identifiers and electronic network activity with our advertising partners so our advertising partners can show ads that are targeted to your interests on other platforms.  Please refer to our Cookie Policy for more information.  We do not knowingly “sell” or “share” Personal Information about consumers under the age of 18.
  • Limitations of Sensitive Personal Information. You can instruct Progyny that, to the extent it has collected Sensitive Personal Information, it limit the use and disclosure of Sensitive Personal Information to specifically permitted purposes.
  • Nondiscrimination. You are entitled to exercise the rights described above free from discrimination in the form of legally prohibited increases in the price or decreases in the quality of our Service.

To exercise your right to opt-out of sale or sharing of your Personal Information under the CCPA, please click the “Do Not Sell or Share my Personal Information” link provided on the website on which this Privacy Policy is posted here, use our cookie preferences tool to disable ad trackers on our website, or contact us by phone or email as indicated above.  Additionally, we make reasonable efforts to honor opt-out preference signals that are set at the device- or browser-level to communicate a consumer’s choice to opt-out of the sale or sharing of Personal Information, provided such signals meet the requirements of the CCPA. Note that if we are not selling or sharing your Personal Information, we will not provide an opt out link on our Sites.

We reserve the right to confirm your California residency to process your requests and will need to confirm your identity to process your requests to exercise your information, access or deletion rights. As a part of this process, government identification may be required. Consistent with California law, you may designate an authorized agent to make a request on your behalf. In order to designate an authorized agent to make a request on your behalf, you must provide a valid power of attorney, the requester’s valid government-issued identification, and the authorized agent’s valid government issued identification. We cannot process your request if you do not provide us with sufficient detail to allow us to understand and respond to it. 

We may not be required to fulfill your requests related to the rights described above in certain circumstances. These include, for example, instances where we must retain data that is necessary to comply with legal obligations, complete a transaction, detect security incidents, or for certain other internal purposes. Additionally we may not be required to fulfill your request if we are unable to verify your identity. We are not required to provide information in response to a request to know for a particular consumer more than twice in any 12-month period.
